1. Acceptance of terms

These Terms of Service ("Terms") govern the use of the PulsePilot Live application (the "App"), provided by Luca Saccinto (the "Controller", "we"). By creating an account or using the App, you ("you", "the user") declare that you have read, understood, and fully accepted these Terms and the Privacy Policy. If you do not accept these Terms, you may not use the App.

2. Description of the service

PulsePilot Live is an application for musicians that offers:

• A free, unlimited professional metronome, including subdivisions and polyrhythms.

• A tool for creating section-based click tracks ("Click Track Creator"), organized into setlists, with voice and visual prompts, complete with a backing track management feature.

• A live performance mode ("Stage Mode") designed for use during live shows.

Available features vary depending on the active plan, as described in Section 4.

3. User account

• A valid email address and account are required to use the Click Track Creator and Setlist features in the paid plans.

• You are responsible for keeping your login credentials confidential and for any activity carried out through your account.

• You agree to provide truthful information when registering and to keep it up to date.

The Free plan is free of charge and does not require any payment method. The Pro, Premium, and Ultimate plans are auto-renewing in-app subscriptions.

4.1 Auto-renewal and payment

• Once activated, each paid plan renews automatically at the end of each billing period (monthly), unless cancelled by the user before the end of the current period.

• Payment is charged to the payment method associated with the user's App Store or Google Play account, subject to the respective store's terms.

• Auto-renewal results in the active plan's amount being charged within the 24 hours preceding the end of the current period, unless renewal is turned off beforehand.

4.2 Cancellation and refunds

• You can turn off auto-renewal at any time from your App Store or Google Play account settings; cancellation takes effect at the end of the billing period already paid for.

• Payment processing, refunds, and any billing disputes are governed by Apple's and Google's respective policies, as they are the exclusive processors of the payment transaction; PulsePilot Live has no access to payment card data and does not process refunds directly.

4.3 Plan changes and downgrades

• If you move to a plan with lower limits (downgrade) or your subscription is not renewed, content exceeding the new limits (number of click tracks or setlists) remains archived but cannot be edited or run in Stage Mode until you select which items to keep within the new plan's limits, or upgrade again.

• The Controller reserves the right to change prices and features of the plans; any material changes to active plans will be communicated with reasonable notice, in compliance with Apple's and Google's applicable policies.

5. User content

• All content created by the user within the App — song names, sections, notes, voice recordings — remains the property of the user.

• By creating such content, the user grants the Controller a limited, non-exclusive license, strictly necessary to store, process, and sync that content for the sole purpose of providing the service (including cloud storage for plans that offer it).

• The Controller does not use user content for any purpose other than providing the service and does not share it with third parties for commercial purposes.

• The user is solely responsible for the content they upload or record and warrants that they hold the necessary rights to use it.

6. Prohibited uses

When using the App, you agree not to:

• Use the App for unlawful purposes or in violation of third-party rights.

• Attempt to gain unauthorized access to systems, data, or other users' accounts.

• Decompile, modify, or distribute the App outside official channels (App Store, Google Play).

• Resell or sublicense access to the App or its content to third parties.

7. Intellectual property

The PulsePilot Live name, logo, interface, source code, and all App materials, excluding content uploaded by users, are owned by the Controller and are protected under applicable intellectual property laws. Unauthorized reproduction of these elements is prohibited.

8. Limitation of liability

• The App is provided "as is". While we are committed to the highest reliability, particularly for the accuracy of the metronome and Stage Mode, the Controller cannot guarantee the App will be entirely free of malfunctions, delays, or interruptions.

• The Controller is not responsible for performance issues during a live show caused by factors outside the App, such as malfunctions of the user's device, operating system interruptions, low battery, or incorrect configuration by the user.

• Users are strongly advised to thoroughly test every click track and setlist before a live performance.

• To the extent permitted by applicable law, the Controller's total liability toward the user is limited to the amount actually paid by the user for the subscription in the 12 months preceding the event giving rise to the liability.

9. Account termination

• You may sign out of your account at any time from the App's My Profile section.

• The Controller reserves the right to suspend or close accounts that violate these Terms, notifying the user where reasonably possible.

10. Changes to these Terms

These Terms may be updated over time. In the event of material changes, users will be notified via an email notice, with the "last updated" date shown at the top of the document. Continued use of the App after such changes constitutes acceptance of the new Terms.
